ISUZU Virtual Vehicle Experience

1. About the Virtual Experience

These Terms of Use and Disclaimer ("Terms") apply to your access to and use of the virtual vehicle experience ("Virtual Experience") made available on the website of Isuzu Motors India Private Limited ("IMI", "ISUZU", "we", "us" or "our").

By selecting "I Agree" and accessing or using the Virtual Experience, you confirm that you have read and understood these Terms and agree to be bound by them. If you do not agree to these Terms, you must not access or use the Virtual Experience.

You also confirm that you are legally competent to enter into a binding agreement. If you are under the age of 18, you may use the Virtual Experience only with the involvement, consent and supervision of a parent or legal guardian.

2. Illustrative and Informational Purpose

The Virtual Experience is provided solely for general demonstration, visualization and informational purposes. All vehicle models, three-dimensional renderings, images, animations, colours, dimensions, specifications, features, accessories, equipment, body applications, configurations, environments and other graphical representations displayed in the Virtual Experience are illustrative representations only.

The Virtual Experience is not:

• an offer, quotation or contractual commitment to sell or supply any vehicle, accessory, equipment, body application or service;
• technical, engineering, legal, safety or regulatory advice;
• confirmation that a displayed vehicle, configuration, accessory or body application is available, approved, compatible or suitable for any particular purpose; or
• a substitute for inspection of the actual vehicle and verification of current product information with an authorized ISUZU dealership.

3. Differences from Actual Vehicles

The appearance, colour, texture, dimensions, features, specifications, equipment, accessories, body applications and configurations of an actual vehicle may differ from those displayed in the Virtual Experience because of screen settings, rendering limitations, product changes, manufacturing variations, model or variant differences, regional requirements or other factors.

Colours displayed digitally may not accurately reproduce the colour of an actual vehicle. The Virtual Experience may not reflect the most recent product updates, model revisions, technical changes, discontinuations or current availability.

4. Product Information and Availability

Vehicle specifications, features, equipment, accessories, body applications, configurations, prices and availability may differ according to the model, variant, location, production period and applicable market requirements. They may be changed, replaced or withdrawn without prior notice.

Before making a purchase decision, placing an order or arranging any vehicle modification, you should obtain written and current information from an authorized ISUZU dealership. Any quotation, order or sale will be governed by the applicable sales documentation and not by the Virtual Experience.

5. Accessories and Equipment

Accessories and equipment displayed in the Virtual Experience may: be optional and available at an additional cost; not form part of the standard vehicle specification; be available only for selected models, variants or locations; be manufactured or supplied by a third party; or be unavailable for purchase.

The depiction of an accessory or item of equipment does not constitute a representation that it is manufactured, supplied, recommended, approved or warranted by IMI. Users should verify the manufacturer, supplier, compatibility, price, installation requirements, warranty terms and availability of each accessory before purchase or installation.

6. Body Applications and Vehicle Modifications

Body applications, conversions, equipment installations and modified vehicle configurations displayed in the Virtual Experience are conceptual visualizations provided solely to demonstrate possible use cases. A displayed configuration should not be understood as confirmation that it is legally permissible, technically feasible, commercially available, registrable, insurable or suitable for use on public roads.

A displayed body application or modification may be manufactured, installed or supplied by an independent body builder, dealer, equipment manufacturer or other third party and may not be manufactured, installed, supplied or warranted by IMI. No dealer, body builder, installer or other third party is authorized to vary these Terms or make any representation, undertaking or warranty on behalf of IMI unless expressly authorized by IMI in writing.

The depiction of any body application, accessory, conversion or modification does not constitute or imply approval, certification, validation, homologation, endorsement or recommendation by IMI; confirmation that the configuration has been designed, manufactured, tested or inspected by IMI; confirmation that it is structurally, technically, operationally or commercially feasible; confirmation that it complies with applicable laws, rules, standards, registration, permit, fitness, type-approval, insurance or local authority requirements; confirmation that the modification may lawfully be registered or operated on public roads; confirmation that any required registration approval or amendment will be granted; confirmation that it is compatible with every vehicle model, variant, chassis, wheelbase or powertrain; confirmation that the vehicle will retain its original payload, axle-load capacity, performance, stability, fuel efficiency, emissions, durability, safety characteristics or warranty coverage; or a commitment that IMI, an authorized ISUZU dealership or any third party will manufacture, supply, install or support the displayed configuration.

No body application, conversion, accessory installation or vehicle modification should be selected, ordered, manufactured or undertaken solely on the basis of the Virtual Experience. Before proceeding with any modification, the vehicle owner should obtain an independent assessment from appropriately qualified professionals and verify all applicable technical, safety, legal, registration, certification, permit, insurance and warranty requirements, and confirm whether prior approval, inspection, testing, certification or endorsement from any governmental, transport or registering authority is required.

The vehicle owner and any person designing, manufacturing, supplying, installing or carrying out a modification are responsible for independently ensuring that the modification complies with all applicable requirements, does not exceed the vehicle's permitted gross vehicle weight, axle-load limits, payload capacity or other technical limitations, and does not adversely affect the vehicle's safe and lawful operation. Certain alterations may require prior or subsequent approval of the registering authority, endorsement in the certificate of registration, fitness certification, permits or other statutory approvals; depiction in the Virtual Experience does not confirm such approvals will be granted.

7. Third-Party Products and Services

Any reference to or depiction of a third-party accessory, body application, body builder, supplier, product, trade mark or service is provided for illustration or identification only and does not necessarily constitute an endorsement or recommendation by IMI.

Third-party suppliers and service providers are independent entities. Unless expressly confirmed by IMI in writing, they are not agents or representatives of IMI and are not authorized to create obligations, representations or warranties on behalf of IMI. To the maximum extent permitted by applicable law, IMI shall not be responsible for the independent acts, omissions, representations, products, installations, services or warranties of third-party suppliers or service providers, except where the relevant responsibility arises from an express written commitment made by IMI or cannot lawfully be excluded.

8. Warranty Implications

Third-party accessories, equipment, body applications and modifications are subject to the warranty, if any, offered by their respective manufacturer, supplier, dealer, installer or body builder. They are not covered by an ISUZU warranty unless expressly stated in the applicable written ISUZU warranty documentation.

Installation or use of a third-party accessory or modification may affect vehicle warranty coverage where a defect, failure or damage is caused or contributed to by that accessory, installation or modification. Users should review the applicable vehicle warranty terms and obtain written clarification before installation. Nothing in this clause excludes or limits any warranty or legal right that cannot lawfully be excluded or limited. Warranty coverage in each case will be determined in accordance with the applicable written warranty terms, the nature and cause of the defect or failure, and the extent to which the relevant accessory, installation or modification caused or contributed to it.

9. User Responsibility

You are responsible for independently assessing whether a vehicle, accessory, body application or configuration is suitable for your intended use. You must not rely solely on the Virtual Experience when making a purchase, operational, technical, modification or investment decision. Vehicles must always be operated in accordance with applicable laws, safety requirements, load limits, operating instructions and the owner's manual.

10. Safe Use of the Virtual Experience

The Virtual Experience may include interactive, animated or immersive content. You should use it only in a safe and stationary environment and in a manner that does not distract you from your surroundings. Do not access or operate the Virtual Experience while driving a vehicle, operating machinery, walking in traffic or undertaking any activity that requires your full attention.

Prolonged viewing of interactive or animated content may cause eyestrain, headache, dizziness or discomfort in some users. Stop using the Virtual Experience if you experience any discomfort and resume only when it is safe and comfortable to do so. Children should use the Virtual Experience only under appropriate adult supervision.

11. Intellectual Property

All rights in the Virtual Experience and its content, including vehicle designs, trademarks, logos, graphics, renderings, animations, audio, software, text and other materials, are owned by or licensed to IMI or the relevant rights holder. You may use the Virtual Experience only for personal, non-commercial viewing.

Except as permitted by applicable law or expressly authorized by IMI in writing, you must not copy, reproduce, extract, download, record, modify, reverse engineer, distribute, publicly display, publish, commercially exploit or create derivative works from the Virtual Experience or its content. No licence or right to use any ISUZU trade mark, logo, design or other intellectual property is granted except for the limited right to access the Virtual Experience in accordance with these Terms. You must not use scraping tools, bots, automated extraction systems or artificial-intelligence training systems to copy or extract any part of the Virtual Experience, except where such restriction is prohibited by applicable law.

12. Availability and Technical Operation

The Virtual Experience is provided on an "as available" basis. Its operation may depend on your device, browser, internet connection, display settings and third-party technologies. IMI does not guarantee that the Virtual Experience will always be available, uninterrupted, secure, error-free or compatible with every device or browser. IMI may update, suspend, restrict or discontinue all or part of the Virtual Experience without prior notice.

13. Limitation of Liability

To the maximum extent permitted by applicable law, IMI shall not be liable for any decision, purchase, installation, modification or other action undertaken solely in reliance on the Virtual Experience without verification through an authorized ISUZU dealership and, where applicable, appropriately qualified technical, legal or regulatory professionals.

To the maximum extent permitted by applicable law, IMI shall not be liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue, business opportunity, anticipated savings or use, arising from access to, use of or reliance on the Virtual Experience. IMI will not be responsible for any unauthorized, unsafe, incompatible or unlawful accessory installation, body application, conversion or vehicle modification carried out by a dealer, body builder, supplier, installer, user or other third party.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability or consumer right that cannot lawfully be excluded or limited.

14. Privacy and Cookies

Personal data and device or usage information collected in connection with the Virtual Experience will be processed in accordance with IMI's Privacy Policy and Cookie Policy, as applicable. Users should review those policies before using the Virtual Experience or submitting personal information.

These Terms should be read together with IMI's Website Terms of Use, Privacy Policy and Cookie Policy. In the event of any inconsistency, the Privacy Policy and Cookie Policy shall prevail in relation to the collection and processing of personal data, and these Terms shall prevail in relation to the operation and use of the Virtual Experience.

15. Changes to These Terms

IMI may revise these Terms from time to time. The version displayed when you access the Virtual Experience will apply to that use. Material changes may be brought to users' attention through the website or the Virtual Experience.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to any rights and forums available under applicable consumer-protection law or other mandatory law, courts of competent jurisdiction at Chennai, Tamil Nadu shall have jurisdiction.
